What is the Energy Audit according to RD 56/2016?

Royal Decree 56/2016 establishes the obligation for large companies to carry out energy audits as part of the measures to improve energy efficiency in Spain. This audit consists of a technical and economic analysis of the energy consumption of the facilities, with the aim of identifying saving opportunities and proposing viable improvements.

The report must cover at least 85% of total energy consumption and comply with the criteria established by European legislation (Directive 2012/27/EU). It is not a simple review: it is a strategic tool to optimise costs, reduce emissions, and modernise the company’s energy management.

Companies subject to the obligation and penalties for non-compliance

All companies that are not considered SMEs are obliged to comply with RD 56/2016, that is, those with more than 250 employees or with an annual turnover of more than 50 million euros, or a general balance sheet of more than 43 million euros.

These companies must carry out an energy audit every four years and register the report with the corresponding body of their autonomous community. In case of non-compliance, the sanctioning regime may impose fines ranging from €10,001 to €60,000 per consumer site. While a basic energy study may be optional and focused on specific equipment, the RD 56/2016 Energy Audit is a legal requirement with defined scope and quality standards. It must cover at least 85% of the company’s total energy consumption and include improvement proposals with an economic analysis.
